1. Acceptance of These Terms
These Terms of Use ("Terms") govern your access to and use of the 9 Square in the Air mobile application and related services (collectively, the "App"), operated by 9 Square in the Air, LLC ("9 Square in the Air," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
If you are using the App on behalf of an organization (such as a school, church, or club), you represent that you have the authority to bind that organization to these Terms.
2. Description of the Service
9 Square in the Air is a companion app for the physical 9 Square in the Air game. The App provides rules and setup instructions, a scorekeeping and timer tool, tournament-hosting tools for group leaders ("Tournament Directors"), and an optional National Leaderboard that ranks participants who submit tournament results.
3. Eligibility and Age Requirements
The physical game and in-person tournaments may be played and enjoyed by people of any age, including children under 13, under the supervision of a parent, guardian, teacher, or other responsible adult.
However, creating an account of any kind through the App — a Player Account or a Tournament Director (leader) Account — requires that the account holder be at least thirteen (13) years old. We do not knowingly permit anyone under the age of 13 to create an account, and we do not knowingly collect personal information through an account from anyone under 13. See our Privacy Policy for more detail on our children’s privacy practices.
A participant under the age of 13 may take part in a tournament in person, but may not create a Player Account and will not be submitted to, or appear on, the National Leaderboard.
If we learn that we have collected personal information from an account holder under the age of 13, we will take steps to suspend or delete that account and the associated information, consistent with our Privacy Policy.
4. Accounts
4.1 Player Accounts
A Player Account requires a username, an email address, your real name, and your date of birth. Your date of birth is used solely to confirm you meet the 13+ age requirement and to place you in the correct age division; the App will not allow you to complete registration with a birth date indicating you are under 13.
Your username, not your real name, is what is shown publicly. If you are 18 or older, you may separately choose to display your real name instead of your username on the National Leaderboard. If you are under 18, your username is always shown, regardless of any setting.
4.2 Tournament Director (Leader) Accounts
A Tournament Director Account lets a group leader create and run tournaments. Before creating a first tournament, and again whenever its terms change, a Tournament Director must accept our Tournament Director Agreement. That Agreement includes a full waiver and release of 9 Square in the Air, LLC, and its owners, officers, employees, and associates, from any and all liability relating to gameplay and to any event or tournament conducted using the game, together with the Tournament Director’s own responsibility for player safety at their event, use of genuine 9 Square in the Air equipment (not a homemade set or an off-brand product), and permission to use event photos/video for promotional purposes.
4.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at customerservice@9squareintheair.com if you suspect unauthorized use of your account.
5. Tournaments and the National Leaderboard
A Tournament Director may submit a completed tournament’s results for inclusion on the National Leaderboard. At the time of submission, the Tournament Director must certify, among other things, that all participants being submitted to the National Leaderboard are at least 13 years old, that any participant under 13 was not submitted and did not create an account, and that the submitted information is accurate. The Tournament Director must also submit a photo of the event and confirm that genuine 9 Square in the Air equipment was used.
We rely on these certifications when accepting tournament submissions and maintaining leaderboard rankings. A false certification may result in removal of the submission and suspension of the Tournament Director’s account.
A Player who self-joins a tournament using a join code separately agrees to a Participant Agreement covering fair play; a release of 9 Square in the Air, LLC, and its owners, officers, employees, and associates, from liability for any injury sustained during the tournament; accuracy of their account information; and the fact that, if their leader submits the event, their username and score become part of the public National Leaderboard.
6. Acceptable Use
You agree not to:
- Provide false information, including about your or another participant’s age, when creating an account or submitting tournament results;
- Create an account on behalf of, or enter information belonging to, anyone under the age of 13;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Use the App for any unlawful purpose, or to harass, abuse, or harm another person;
- Attempt to circumvent any age-gate, account limitation, or security feature of the App;
- Submit tournament results you know to be inaccurate or fraudulent.
7. Fees and Payments
Certain features, such as hosting a tournament, require the purchase of a consumable "Tournament Credit" through Apple’s in-app purchase system. All payments are processed by Apple; we do not directly collect or store your payment card information. All sales are subject to Apple’s own terms and refund policies.
Tournament entry fees, when a leader chooses to charge one, are collected by the Tournament Director directly from participants, outside of the App. 9 Square in the Air is not a party to, and assumes no responsibility for, that transaction.
8. Suspension and Termination
We may suspend or terminate your account, without notice, if we believe you have violated these Terms, provided false information (including about age), or if we determine an account was created by or for someone under the age of 13. You may also delete your own Player Account at any time from within the App.
Upon suspension, your account is hidden from the National Leaderboard and normal account features are disabled until the suspension is lifted. Upon deletion, we remove your directly-identifying profile information; certain non-identifying records (such as an anonymized points history) may be retained as described in our Privacy Policy.
9. Disclaimers
9 SQUARE IN THE AIR IS A PHYSICALLY ACTIVE GAME. TOURNAMENT DIRECTORS ARE SOLELY RESPONSIBLE FOR PROPERLY SETTING UP AND INSPECTING EQUIPMENT, SUPERVISING PLAY, AND ENSURING THE SAFETY OF PARTICIPANTS AT THEIR OWN EVENTS. THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
10. Limitation of Liability; Release
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE 9 SQUARE IN THE AIR, LLC, AND ITS OWNERS, OFFICERS, EMPLOYEES, AND ASSOCIATES, FROM, AND AGREE THAT NONE OF THEM SHALL BE LIABLE FOR, ANY INJURY, DAMAGE, OR LOSS ARISING FROM YOUR USE OF THE GAME, YOUR USE OF THE APP, OR YOUR PARTICIPATION IN OR HOSTING OF A TOURNAMENT.
11. Indemnification
You agree to indemnify and hold harmless 9 Square in the Air, LLC, and its owners, officers, employees, and associates, from any claim arising out of your breach of these Terms or your use of the App, including as a Tournament Director hosting an event.
12. Changes to These Terms
We may update these Terms from time to time. Material changes affecting a certification or agreement you’ve already accepted (such as the Tournament Director Agreement) will require you to re-accept the updated version before continuing to use the affected feature.
13. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be subject to the jurisdiction of the state and federal courts located in Missouri, and you consent to personal jurisdiction and venue there.

Privacy Policy
9 Square in the Air

1. Overview
This Privacy Policy explains what information 9 Square in the Air, LLC ("9 Square in the Air," "we," "us," or "our") collects through the 9 Square in the Air mobile application (the "App"), how we use it, and the choices you have. It applies to the App’s Player Accounts, Tournament Director (leader) Accounts, and the National Leaderboard.
This Policy is written with particular attention to children’s privacy, because the App is used in settings — school PE classes, church youth groups, camps — where people under the age of 13 are commonly present, even though the App’s accounts and leaderboard are limited to users 13 and older. See Section 4 below.
This Policy covers the 9 Square in the Air mobile app only. Our online store has its own separate privacy policy.
2. Information We Collect
2.1 Player Account information
When you create a Player Account, we collect:
- A username (shown publicly on the National Leaderboard);
- Your real name (visible only to your tournament’s leader and to 9 Square in the Air staff, unless you are 18 or older and separately choose to display it publicly instead of your username);
- Your email address;
- Your date of birth, used only to confirm you are at least 13 years old and to place you in the correct age division for leaderboard purposes; and
- The state you live in, so we can offer state-level leaderboards.
We may in the future collect more specific, limited geographic information (such as a ZIP code) to help connect you with tournaments in your local area. We do not collect your device’s live or precise location.
2.2 Tournament and gameplay information
When you participate in a tournament, we collect the scores and results associated with your account, and the tournaments you’ve taken part in.
2.3 Tournament Director (leader) information
A Tournament Director provides an email address, name, and their organization’s name and address (city, state, and zip code, used to distinguish between organizations that share a common name); may submit event photos or video, which we may use to promote 9 Square in the Air; and has a tournament credit balance tracking how many paid tournaments they have remaining to host.
2.4 Roster entries added by a Tournament Director
A Tournament Director may add a participant to a tournament’s roster directly, without that person creating their own Player Account — for example, a teacher entering a class roster. In that case, we store only the name the Tournament Director enters (no account, email address, or other information is created or collected for that person). The App instructs Tournament Directors entering names this way to use a first name and last initial rather than a full name, out of care for participants’ privacy, including children who may be present.
2.5 Crash and diagnostic data
If the App crashes, we automatically receive a technical crash report — device model, operating system version, and what the App’s code was doing at the time — through Firebase Crashlytics, so we can find and fix the problem. This report is not linked to your name.
2.6 Information we do not collect
We do not use advertising or analytics-tracking SDKs. We do not collect payment card information (in-app purchases are processed entirely by Apple), and we do not collect participants’ phone numbers.
3. How We Use Information
- To create and operate your account;
- To operate tournaments and the National Leaderboard;
- To communicate with you about your account or a tournament;
- To enforce our Terms of Use, including our 13+ eligibility requirement; and
- To promote 9 Square in the Air using event photos/video submitted by Tournament Directors.
4. Children’s Privacy (COPPA)
The App is not directed to children under the age of 13, and we do not knowingly collect personal information from anyone under 13 through an account. Creating a Player Account or a Tournament Director Account requires confirming a date of birth showing the account holder is at least 13; the App will not allow account creation to proceed with a birth date indicating the person is under 13.
A child under 13 may still participate in a 9 Square in the Air tournament in person, under the supervision of a parent, teacher, or other responsible adult — but that participation does not involve creating an account or collecting personal information through the App, and that child will not be submitted to, or appear on, the National Leaderboard. When a Tournament Director submits a tournament to the National Leaderboard, they must certify that no participant under 13 is being submitted and that no such participant has created an account.
If we obtain actual knowledge that we have collected personal information from an account holder under the age of 13, we will suspend or delete that account and the associated personal information. If you believe a child under 13 has created an account, please contact us immediately at customerservice@9squareintheair.com so we can investigate and, if confirmed, remove the account.
If we later learn that an account holder provided an inaccurate birth date and was actually under 13 at some point while using the App, we will remove any points earned before their 13th birthday. If the account holder is still under 13 at the time we learn this, we will delete the account entirely rather than merely adjusting it. If the account holder has since turned 13, we will not delete the account, but will reduce their point balance to remove the points earned before they turned 13.
5. How We Share Information
We do not sell your personal information. We share information only with:
- Service providers who host and operate the App’s backend — currently Google Firebase (sign-in, database, event photo storage, crash reports, and staff notifications) and Apple (in-app purchases and app distribution) — solely to provide the App’s functionality;
- Our affiliates and related entities — meaning other businesses, ministries, or nonprofit organizations under common ownership or leadership with 9 Square in the Air, LLC — for purposes consistent with this Privacy Policy;
- Your tournament’s leader, who can see your real name and tournament participation;
- The public, in the limited form of your username and score, if your leader submits your tournament to the National Leaderboard (or your real name instead, only if you are 18+ and have opted in); and
- Law enforcement or other parties, if required by law or to protect the rights, safety, or property of 9 Square in the Air or others.
6. Data Retention
We retain your account information for as long as your account is active. If you delete your account (available at any time from within the App) or if we delete it for a policy violation, we remove your directly-identifying profile information (username, real name, email, birth date). A record of point totals associated with the deleted account may be retained in anonymized form, containing no personal information, for leaderboard-integrity and audit purposes.
If a Tournament Director deletes their own account, the tournaments they ran — including the profiles, scores, and results of the other real people who played in them — remain on record. Deleting a Tournament Director’s own profile never deletes or erases any participant’s own profile or scores.
We also keep an internal record of account suspensions and deletions — including the reason and the staff member who took the action — for our own compliance and audit purposes. This internal record is not visible to other users.
7. Your Choices and Rights
- You can review and edit your profile information (username, name, state, leaderboard display preference) at any time from within the App.
- You can delete your Player Account at any time from within the App.
- You can contact us at customerservice@9squareintheair.com with any question about your information, including a request to access or delete it.
8. Account Suspension or Removal
We reserve the right to suspend or permanently remove any account that violates our Terms of Use — including an account we discover was created by, or contains information about, someone under the age of 13, or an account associated with false certifications at tournament submission. A suspended account is hidden from the National Leaderboard and blocked from normal use until reinstated. A removed account’s profile information is deleted as described in Section 6 above.
9. Security
We use reasonable administrative and technical safeguards designed to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Changes to This Policy
We may update this Policy from time to time. We will post the updated Policy at this page and update the "Last Updated" date above.
