Your use of this website constitutes your agreement to the following conditions.

When you visit 9squareintheair.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Use of product
Purchase of the product serves as your acceptance of acceptable uses of the product. Customer also agrees to hold harmless 9 Square in the Air, LLC for any injury, including death, that may result from use of the product.
Acceptable Use of Product
- Players are not permitted to hang from or touch any part of the game structure during game play.
- Appropriate adult supervision is required when the game is played by minors.
- The product will only be used on flat, dry, non-skid surfaces.
9 Square in the Air is under United States Patent protection (Issued Patents, nos 650445 & 656995). The following actions are prohibited.
1. Creating, manufacturing or selling any comparable product that results in a 3-dimensional game for nine players as described.
2. Selling written or recorded plans and drawings to construct the game.
All services provided by Provider may only be used for lawful purposes. The laws of the State of MISSOURI, and the United States of America apply.
The customer agrees to indemnify and hold harmless Provider from any claims resulting from the use of our products.
Use of our products to infringe upon any copyright, trademark or patent is prohibited.
You agree to supply appropriate payment for the services received from Provider, in advance of the time period during which such services and products are provided. You agree that until and unless you notify Provider of your desire to cancel any or all products ordered, those products will be billed.
Cancellations must be done in writing via the cancellation process provided. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you in writing (typically email) that your order has been canceled.
When ordering a product that is on pre-order or backorder status, customer understands and agrees that their credit card will be charged in full at the time of the order.

See the Refund Policy for complete details. Violations of the Terms of Service will waive the refund policy.
Customers can make payment by credit card, or some other method prearranged with 9Squareintheair.com.
Your total cost for purchase of any product will include the shipping and handling charges shown on your 9 Square in the Air invoice. However, your original shipping fees are non-refundable in the case of a returned product. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to 9 Square in the Air.
Customer agrees that it shall defend, indemnify, save and hold Provider harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Provider, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Provider against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Provider; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
Provider shall not be responsible for any damages your organization may suffer. Provider makes no warranties of any kind, expressed or implied for the products we provide.
Changes to the TOS
Provider reserves the right to revise its policies at any time without notice.
